TERMS & CONDITIONS OF PURCHASE AND DELIVERY
By purchasing merchandise from ArtisticInteriors.com (Ai), You, the Customer (You/Your),
accept and agree to be bound by the following TERMS & CONDITIONS OF PURCHASE AND DELIVERY.
Ai, at its sole discretion, may alter or change these TERMS & CONDITIONS OF PURCHASE AND DELIVERY, at any time. Ai shall honor its Terms and Conditions, set forth, that is concurrent with and effective at the time of any given purchase.
Currently, delivery is available throughout the continental USA, only (48 states).
Currently, Ai is offering free shipping on all purchases over $800 (US). Purchases at or less than $800 will be subject to a delivery fee, not to exceed $150. You agree to pay the maximum delivery fee of $150 at the time of Your purchase. The actual delivery fee for Your item(s) will be assessed, when the order is processed, and You agree to allow Ai to refund the difference, between your paid fee amount and the actual delivery fee cost, when Ai processes Your order.
i. Allowable Cancellation Timeframe You may cancel Your order, within 24 hours of purchasing merchandise. At Ai’s discretion, You may be charged a $50 processing fee. To cancel Your order, please, email us at: support@ArtisticInteriors.com (we will need Your cancellation in writing) AND call us, at: 888-858-5255. Be prepared to provide all pertinent information, regarding Your order.
ii. Orders In Transit
After a period of 24 hours, Your order shall be processed and considered to be ‘in transit’; Therefore, You may not cancel Your order, after 24 hours from the time You made Your purchase.
iii. Special Orders/Items/Deals
ORDERS ACCEPTED BY THE CUSTOMER OR SPECIAL ORDERS MAY NOT BE CANCELED. A special order is an order of custom furniture, in terms of size, material, or color/ pattern; floor model items, clearance items, inventory sale items and/or items sold, subject to a special discount.
Returns or Exchanges of regular merchandise can be made within 24 hours of receiving the product. All returned products must be free of damage and in original condition (not used, not assembled and not installed, with all original packing materials included). A 20% restocking fee is applied to all returned merchandise. The original Shipping and Delivery Costs are not refundable. Prior to returning the merchandise, You must email or call Ai for a Return Authorization Number (RA). Any merchandise received without a Return Authorization Number, will not be accepted. The return shipping costs shall be the burden of You. Any unpaid freight charges will be deducted from your refund. You shall have the burden of packing returned merchandise, soundly, without damaging said merchandise, before said items are picked up for return. In the case merchandise is damaged by You, Your rights shall be limited to the manufacturer’s warranty, if any, and Ai, at its sole discretion, may make a deduction from Your refund, accordingly.
Typically, items are in stock and ship within a week. However, You understand and agree, all delivery dates are estimated. An exact delivery date can change, due to production timeframe, overseas loading plans, and freight shipment logistics. You understand and agree, if You miss the scheduled delivery time, a fee of $95 will be charged to Your account. You understand and agree; delays caused by weather, logistics or third party production schedules are beyond the control of Ai. Ai has no ownership of manufacturers, ports, vessels, or freight shipping/delivery companies.
CONDITION OF PRODUCTS
Finishes, color, texture, and graining variations can occur in natural products like leather, wood and stone. These are not considered imperfections and/or defects. For all colors, other than black and white, leather products are bound to have variations in every production line. Color representations on computer terminals and screens can vary, based on settings and various display technologies. You understand and agree; You are purchasing, online, at Your own risk, and may not and shall not seek any refunds, make any claim, or initiate any dispute, based on the finish, color or texture or any other variation of a physical attribute.
CORRECTIONS/CHANGES TO WEBSITE
Ai reserves the right to correct errors, inaccuracies or omissions, and to change or update information, at any time, without prior notice, whether or not relevant orders are pending. CLAIMS A. Delivery Instructions and Your Obligations PLEASE, NOTE: IF MERCHANDISE WAS DAMAGED, SUBSTANTIALLY, DURING SHIPPING, DO NOT ACCEPT DAMAGED MERCHANDISE. REFUSE DELIVERY AND RETURN MERCHANDISE WITH DELIVERY COMPANY. THE DELIVERY DRIVER MUST WAIT, WHILE YOU INSPECT. IF THE DRIVER DOES NOT AGREE TO WAIT, NOTE, “DRIVER REFUSED TO WAIT”, ON THE BILL OF DELIVERY, AND REFUSE THE ENTIRE SHIPMENT. UPON YOUR NOTIFICATION OF SAID EVENT, Ai WILL RESCHEDULE YOUR DELIVERY.
i. Total Substantial Damage If, upon delivery, all of Your merchandise is damaged, substantially, You must document it, by writing, “DAMAGED UPON ARRIVAL”, on the Bill of Delivery, in place of Your signature, where, you were to sign for the item(s), and take pictures of said damage(s) and annotated Bill of Delivery, and refuse delivery. Carefully note exact damages on the Bill of Delivery.
ii. Partial Substantial Damage
If, upon delivery, select item(s) of Your order are damaged, substantially, You must document it, by writing, “DAMAGED UPON ARRIVAL”, near the damaged item’s SKU/Description on the Bill of Delivery, and carefully describe the damage and take pictures of said damage(s). You shall take delivery of all items, not damaged. However, You shall not keep any undamaged part of a damaged item, which, comes as a set (i.e. sofa with ottoman, etc.).
iii. Minor Damage To An Item
If, upon delivery, select item(s) of Your order have sustained minor damage, You must document it, by writing, “DAMAGED UPON ARRIVAL”, near the damaged item’s SKU/Description on the Bill of Delivery, and carefully describe the damage and take pictures of said damage(s). At Your option, You may choose to call Ai and accept a discount, to take delivery of said item(s) or refuse delivery. However, You shall not keep any undamaged part of a damaged item, which, comes as a set (i.e. sofa with ottoman, etc.).
iv. Missing Items/Parts
If, upon delivery, select item(s)/parts of Your order are missing, You must document it, by writing, “MISSING ITEM”, near the item’s SKU/ Description on the Bill of Delivery. However, You shall not keep any part of an item, which, comes as a set (i.e. sofa with ottoman, etc.).
B. Claims After Delivery
If You have any claims, other than what was noted on the delivery receipt, it is upon the sole discretion of Ai how to resolve the matter. If You have failed to follow Ai’s Terms and Conditions, as per this TERMS & CONDITIONS OF PURCHASE AND DELIVERY, Ai shall not be responsible for any damages, shortages or any other claims.
C. Procedures and Deadlines
All claims will be resolved and authorized by an appropriate supervisor of Ai. Decisions by a sales/support representative or delivery team will not be accepted or authorized by Ai. In order to be considered, each claim must be filed by You within 24 hours from the time of delivery. To file Your Claim, send a written explanation with photos of the damage and a photo of the Bill of Delivery to: support@ArtisticInteriors.com. Ai shall have 72 hours to respond to Your claim. It is Your responsibility to file said claim and to call Ai, immediately, at: 888-858-5255, upon filing the claim, during Ai’s hours of operation, to make sure the proper and needed information was received.
D. Annotating Damages
It is important to be as detailed and descriptive, as possible, about any damage(s), on the Bill of Delivery, before you sign for your items. A signature indicates acceptance; without inspecting the boxes, you are accepting the shipment “as is” and will be fully responsible for any replacements (including freight) or repair costs, even if damages are transit related. If You have signed the Bill of Delivery, without any notation of missing parts or damages, Ai is unable to resolve any claims, as all sales are final.
E. Pre-Inspection By Ai
You understand and agree, all merchandise is inspected, before being shipped to You. Therefore, furniture deliveries are assumed to have been received in good condition by You, UNLESS You note items, which, have been damaged in transit. You have the right AND the responsibility to inspect all items, carefully, during the time of delivery. If anything is missing, You MUST list the missing items on the Bill of Delivery and sign for the accepted items. You MUST retain applicable packaging materials and notify us of any damages or shortages, immediately, as described under Procedures and Deadlines, herein.
F. Refusal of Undamaged Merchandise
And YOU UNDERSTAND AND AGREE; IF YOU REFUSE TO ACCEPT DELIVERY OF YOUR ORDER FOR ANY REASON OTHER THAN THE PRODUCT BEING DAMAGED IN TRANSIT, YOU ARE LIABLE FOR ALL OUTWARD AND RETURN FREIGHT CHARGES INCURRED BY YOUR REFUSAL, AND A 20% PROCESSING/ RESTOCKING FEE.
G. Your Failure To Receive Shipment
Once a customer representative notifies You about Your order delivery, You must make Yourself available, within 2-3 weeks, to accept said delivery. The tracking company will call You to schedule the exact date and time frame for delivery. If You are not available or unable to take the scheduled delivery, the tracking company allows up to 3 days to reschedule. After 3 days, a storage fee will be charged to You. Further, redelivery fees may apply.
H. Failure to Note Damage or Retain Packing Materials
You understand and agree, in the event that damage is not noted on the Bill of Delivery, when signed “received in good condition”, or the applicable packaging materials are not retained, a claim may not filed with the tracking/delivery company. Your Obligations to Inspect, Record and Report Damages All deliveries are insured, therefor, all claims, noted at the time of delivery, will be filed with the shipper, by Ai, based on our findings and pictures, only upon receiving a claim from You. If the damage is severe, You agree to refuse ONLY the item(s) that are damaged, and make notations on the Bill of Delivery. You shall not keep any part of a set of items (i.e. sofa and ottoman, etc.). You are obligated to take photographs of the damaged merchandise and said Bill of Delivery, whether the damaged merchandise is accepted or refused, at the time of delivery, and shall provide such photographs to Ai, immediately. Please, make sure You have sufficient help to unpack and inspect the merchandise, promptly, as the driver will be on a tight schedule, when the delivery type You have selected is “curb side”. If it is found that any of the larger products, upon delivery, will not fit through any doors/stairwells and the product is subsequently returned/ refused, You are responsible for all outward & return carriage costs, and any damages to merchandise, caused by Your handling of said merchandise.
